BHA and BBPA celebrate High Court victory
The British Hospitality Association and the British Beer and Pub Association have won a High Court case in which Phonographic Performance Ltd (PPL) appealed against a decision by the Copyright Tribunal on the tariffs for playing music in public areas in pubs, bars, restaurants and hotels.
The Tribunal ruled that PPL's tariff increases, dating back to 2005-2006, were unreasonable; it allowed only a 10 per cent all-round increase plus RPI. It also accepted that refunds should be given to all those businesses that had paid over the odds since the new tariffs were imposed - estimated to amount to some £15-£20m. Annual savings for the hospitality industry going forward are estimated at £5m. Similar sums apply to the retail sector, which won a parallel case.
In the High Court, the Appeal Judge Mr Justice Arnold, dismissed PPL's appeal and ruled in favour of the BHA and BBPA.
The dispute began when Phonographic Performance Ltd (PPL) raised tariffs for playing music in bars, hotels, restaurants and pubs by up to 403 per cent. The BHA and the BBPA persuaded the Government to refer the new tariffs to the Tribunal and a first hearing in November 2007 led to this appeal on jurisdiction issues, which was won by the two associations.
"This successful result shows, once again, the importance of having a strong trade association to defend the industry's interests, given the enormous amount of time and effort needed to fight these cases," said Martin Couchman, deputy chief executive, BHA. |
